Hooning investigations

ROSEWOOD OIC Sgt Travis Ehrich said new legislation under the Summary Offences Act 2005 has been passed, for the purpose of discouraging the commission of racing, burn outs and other hooning offences.

“This legislation is targeted towards those in attendance at hoon offences as well as those who are filming and promoting hooning offences,” he said.

“An additional offence has been created for possessing a thing that is to be used, or has been used in a hooning offence.

“Actively being in attendance, filming, posting, promoting or possessing something that has been used, or is to be used in a hooning offence, other than a motor vehicle is now an offence.”

The offences under the Act are:

19C Unlawful conduct associated with commission of racing, burn out or other hooning offence …

A person must not:

(a) Willingly participate in a group activity involving a motor vehicle being used to commit a racing, burn out or other hooning offence.

(b) Organise, promote or encourage another person to participate in, or view, a group activity involving a motor vehicle being used to commit a racing, burn out or other hooning offence.

(c) For a purpose mentioned in paragraph (b), photograph or film, or publish a photograph or film of, a motor vehicle being used to commit a racing, burn out or other hooning offence.

Maximum penalty: 40 penalty units or 1 year’s imprisonment.

19D Possession of things used in commission of racing, burn out or other hooning offence

(1) A person must not possess a thing that is being, is to be, or has been used to commit a racing, burn out or other hooning offence.

Maximum penalty: 40 penalty units or 1 year’s imprisonment.

Rosewood Police are targeting hooning behaviours in the Rosewood area due to an increase in traffic complaints of dangerous driving.

On May 31, Rosewood Police issued a Walloon man, 18, with a notice to appear for the offence of creating unnecessary noise and smoke. The incident relates to allegations that the man performed burn-outs on a road in Ebenezer on May 19.

Several other vehicles were observed at the location and investigations are continuing. Further arrests are likely.
